    Depends whether you have any interest in observing international law and
    convention. Traditionally pirates and other criminals don't bother.

    Pre-emptive strikes are legal. And, once you have done that, actually
    making a declaration of the blindingly obvious seems superfluous, but it might be worth doing if there are a lot of pedants around, who are more interested in trifling bits of paper than acts.

    And the reasons for a pre-emptive strike can easily be manufactured. An
    example of this being what is known as The Gleiwitz incident, which was a
    false flag attack on the radio station at Gleiwitz (then Germany and now Gliwice, Poland) was staged by Nazi Germany on the night of 31 August 1939.


    Along with some two dozen similar incidents, the attack was manufactured by Germany as a casus belli to justify the invasion of Poland.

    Despite the German government using the attack as a justification to go to
    war with Poland, the Gleiwitz assailants were not Polish but were German SS officers wearing Polish uniforms.

    A more modern version was that of 2008, when Russia sent un-uniformed
    soldiers to stir unrest in Georgia. When GeorgiarCOs government responded, Russia invaded. And in 2014, Russian special forces entered Ukraine
    pretending to be local self-defense forces and seized government buildings, leading to RussiarCOs occupation of Crimea.
