"06 May 2026 JUSTICE
PRINTFLACrCOs judicial-review concerns remain
FLAC (Free Legal Advice Centres), which promotes access to justice,
says that it still has rCLsignificant concernsrCY [. . .]
[. . .] rCLa radical curtailmentrCY of access to judicial review.
It believes that the plans are likely to have a disproportionately
negative impact on people that it represents in cases involving public
services such as social housing, emergency accommodation, additional educational supports, and access to basic social-welfare payments.
[. . .]
[. . .] rCLsubject to drafting and Government approvalrCY.
[. . .]
FLAC chief executive Eilis Barry welcomed the engagement with the
department but pointed to rCLserious concernsrCY that remained.
rCLFor example, we do not see any justification for its proposed
reduction of the already very restrictive 12-week time limit for
taking a case to eight weeks.
rCLIf implemented, this restrictive time limit will put access to
judicial review out of reach for people who donrCOt have the resources
to pay for and access immediate legal assistance,rCY she stated.
rCLOur concerns also remain about proposals to limit the courtrCOs
discretion to grant judicial review, to limit the availability of
appeals in judicial-review cases, or to restrict when even successful applicants may be awarded their costs,rCY Barry stated.

"I myself: Right but em, I mean does this mean that it it's impossible
for me eh to privately instruct you?
A Free-Legal-Advice Centre: Oh God definitely yeah! No. [. . .] We
don't take on any of this. We're just a free-legal-advice. It's more a free-legal-advice clinic rather than a directory and and I I get your
point now you're looking for a specific firm or a specific solicitor
[. . .] that's definitely not something I can help you with.
[. . .]
A Free-Legal-Advice Centre: [. . .] if that's unsuccessful, judicial
review that's possibly but again you would need to consult a solicitor
for that, privately obviously, [. . .] as we're only the
free-legal-advice solicitors we we couldn't obviously take on a case
for ye. Well we don't. We're only volunteers[. . .]"
