    No Panamanian born in that hospital or the Canal Zone would have been an American.

    The problem was that the Canal Zone was always part of Panama, never US sovereign territory. The US simply operated the Canal and adjacent lands.

    He should have inherited citizenship from his parents, both of whom were American, but the Immigration and Nationality Act in that era was badly
    drafted with regard to Americans born abroad. Later amendments to the
    Act didn't apply retroactively to McCain's situation. His parents had to have him declared an American citizen nine months after hus birth.

    If it had come to it, I'm sure there would have been a dozen or so
    lawyers chomping at the bit to make case law on an issue nearly unique
    to McCain's eligibility to be president, but it sure as hell wouldn't
    have applied to anyone else.

    It's going to be interesting to see what she says about reparations
    now.... No it's not!

    Her crew can bring up the "one drop rule" and say that
    only whites have to pay reparations to Hostin and others.


    The fishwives are not remotely interesting except
    as a phenomenon in how low a broadcaster can go in filling air time.
    But it will be a test of her ability to overcome her own hypocrisy. I
    have no doubt that she will *fail* that test.

    I agree, that's why I'm saying it would have been utterly stupid to make
    it a test case. but lawyers would have wanted the fame and it likely
    would have happened.

    There was no grant of American citizenship before we were a nation.
    People whose home was in the United States at the tine the Constituion
    was adopted were eligible to be president, likely with an exception for
    Indians not taxed. The natural born citizen eligibility applied only
    after adption, It couldn;t be retroactive.
