    A federal civil rights complaint has been filed against the University
    of Washington, targeting the schoolrCOs policies on bathrooms and locker rooms. Sarah Parshall Perry, Vice President and legal fellow at
    Defending Education, said that the university is forcing female students
    to share intimate spaces with biological males based solely on
    self-declared gender identity.

    Perry, a former senior counsel in the U.S. Department of EducationrCOs
    Office for Civil Rights, argued this is a direct violation of Title IX.

    rCLUW allows clearly, openly and on their website, males to use womenrCOs bathrooms and locker rooms based on their own self identified gender identity,rCY Perry told The Jason Rantz Show on Seattle Red 770 AM.

    Perry noted that some buildings offer no single-sex options at all: rCLIf
    any young woman is uncomfortable in a buildingrCa she has to go all the
    way across campus to be able to find one where she can actually close
    the door and be alone without a natal male being in her space.rCY

    Redefining sex vs. gender identity
    The core of the legal argument rests on the definition of rCLsexrCY under federal law. Perry argues that Title IX was only ever intended to
    prevent discrimination based on biological sex, not gender identity.

    rCLSex is not the same as gender identity, and the Supreme Court has never held that it is,rCY Perry stated.

    She noted that while the previous administration attempted to expand
    these definitions, the current administration is returning to a
    long-standing interpretation of the law.

    The complaint emphasizes that because the University of Washington
    accepts federal funding, it must follow federal law over conflicting
    state laws.

    rCLThe ConstitutionrCOs Supremacy Clause makes very clear that when state
    and federal law clash, it is the federal law that is the rCysupreme law of
    the land,'rCY Perry explained. rCLYou are under no obligation, UW, to take federal funding. But once you do, you suddenly become beholden to Title Nine.rCY

    Pronoun policies and first amendment concerns
    Beyond physical spaces, the complaint flags the universityrCOs pronoun enforcement policies. Perry suggests these policies could punish
    students for not complying with preferred pronouns, which she views as a violation of the First Amendment and a form of forced speech.

    rCLYou cannot force a student to use mandatory preferred pronouns without running afoul of the First Amendment,rCY Perry said, citing recent federal appellate rulings.

    The complaint also highlights the universityrCOs rCLQ Center,rCY which receives over $600,000 in federal funding. Perry noted that the center distributes items like chest binders and stand-to-pee devices. She
    argued this points to a broader culture at the university and could lead
    to further legal claims through the Department of Health and Human
    Services (HHS).

    rCLIt is something that is absolutely endemic to the culture at the
    University of Washington,rCY Perry said. rCLI lay the blame squarely at the feet of the administrators there and at the governorrCOs mansion.rCY The complaint seeks to hold the university accountable for what Perry
    describes as an intentional choice to ignore federal civil rights
    protections for women.
